不久前我们刚刚报道过,美国司法部执行 WeChat 禁令的要求并未因为递交的新证据而被加州法官 Laurel Beeler 接受。对于这一结果司法部向第九巡回法院提出了上诉,而法院的三人法官小组在审理之后,最终还是做出了维持 Beeler 法官临时禁止令的决定。他们判决的理由,是在上诉期间美国「并不会即刻受到无法弥补的损失」。

对于司法部来说,如果还想达到实施禁令的目的,接下来还有上诉到美国最高法院这步棋可以走。而恰恰是在今天,参议院刚刚投票通过了大法官 Amy Barrett 的提名。这位法官给外界的感觉可能相对会更偏向特朗普政府,司法部如果进一步上诉,结果会不会改变还真是不太好说呢。
